1. General Conditions
1.1. These Terms & Conditions (T&C) govern the use of babysitting, elderly care, and pet care services provided by Benefit Care Sp. z o.o. ("Benefit Care") to employees of SNOWFLAKE POLAND Sp. z o.o. ("Company").
1.2. By utilizing the services, the employee ("Employee") agrees to these T&C.
1.3. Benefit Care is solely responsible for providing the services; SNOWFLAKE POLAND Sp. z o.o. is not liable for their execution.
1.4. The Employee confirms that they have full legal authority to request the caregiving services and that the information provided to Benefit Care is accurate and up-to-date.
1.5. Employees must inform Benefit Care of any special requirements, medical conditions, or necessary accommodations for the person receiving care.
2. Service Scope & Booking
2.1. Services are available for childcare, elderly care, and pet care.
2.2. Employees must request services at least 24 hours in advance via email to babysit@care-express.pl, providing:
2.3. The minimum booking time per session is 4 consecutive hours.
2.4. Services are available Monday to Saturday, 7:00 AM - 10:00 PM, excluding public holidays.
2.5. Any service outside standard hours requires prior approval and may incur additional costs.
2.6. Last-minute requests (submitted less than 24 hours before the service) may be subject to additional charges or may not be accommodated due to availability constraints.
3. Package Usage & Limitations
3.1. Employees have unlimited access to caregiving services, subject to availability.
3.2. Hours booked but not used without 24-hour prior cancellation must still be paid for.
3.3. If cancellation is made less than 5 hours before the scheduled service, the entire booked session will be charged.
3.4. Babysitters and caregivers are assigned based on availability; requests for specific caregivers will be considered but are not guaranteed.
3.5. Employees must respect the scheduled hours. If the service extends beyond the initially booked time, additional hours will be billed accordingly.
4. Employee Responsibilities
4.1. Employees must provide accurate booking details, including time, location, and service scope.
4.2. Employees must ensure a safe environment for caregivers and provide necessary instructions for handling children, elderly persons, or pets.
4.3. Employees must provide all necessary equipment, food, medication, or other essential items required for care.
4.4. Employees are responsible for covering transport costs for babysitters for shifts ending between 10:00 PM and 7:00 AM (e.g., taxi fare up to PLN 50) or arranging safe transport for the caregiver.
4.5. Employees must notify Benefit Care immediately of any issues or complaints related to service quality.
4.6. Employees must not engage caregivers for direct, private employment during and up to 12 months after service use. Any violation will result in a contractual penalty equivalent to lost revenue.
5. Service Quality & Compliance
5.1. Benefit Care guarantees that all caregivers meet legal requirements and uphold high standards of care.
5.2. Caregivers must adhere to hygiene and safety guidelines, including COVID-19 precautions.
5.3. Employees may provide feedback regarding service quality, and Benefit Care will take necessary corrective actions.
5.4. Benefit Care reserves the right to refuse service to Employees who repeatedly violate these T&C or mistreat caregivers.
6. Confidentiality & Data Protection
6.1. Benefit Care and the Company will handle employee data in compliance with GDPR and Polish data protection laws.
6.2. Employees consent to the processing of their personal data for service provision purposes.
6.3. Personal data will not be shared with third parties except as required by law.
6.4. Employees have the right to access, correct, or delete their personal data upon request.
6.5. Benefit Care will store service records for up to 12 months for quality assurance and dispute resolution purposes.
7. Liability & Dispute Resolution
7.1. Benefit Care is solely responsible for service execution; SNOWFLAKE POLAND Sp. z o.o. is not liable for any claims related to service performance.
7.2. Employees must report service complaints to Benefit Care immediately for resolution.
7.3. Any disputes arising under these T&C shall be governed by Polish law and resolved by the competent court in Warsaw.
7.4. Benefit Care maintains appropriate liability insurance for its services. Any claims must be reported within 7 days of service completion.
8. Amendments & Final Provisions
8.1. Benefit Care reserves the right to update these T&C with prior notice to employees.
8.2. Continued use of the services after amendments constitutes acceptance of the revised T&C.
8.3. These T&C come into effect upon the Employee’s first use of Benefit Care services.
8.4. Benefit Care reserves the right to terminate an Employee’s access to services if there is repeated non-compliance with these T&C.
By utilizing the caregiving services, the Employee acknowledges and agrees to these Terms & Conditions.
