§1 Subject of the Agreement

  1. Subject of the Agreement: BENEFIT CARE commits to delegating a Babysitter to the Client for providing Premium childcare services as per the conditions outlined in §2 of the Agreement.
  2. Ensuring Child Safety: The Babysitter must provide care while ensuring the highest safety standards for the child.
  3. Client's Declaration: The Client confirms full parental rights or legal guardianship of the child. Any changes in this regard must be reported to BENEFIT CARE.
  4. Recording Devices: The Client must inform BENEFIT CARE about the installation of any image or sound recording devices in the place of service.

§2 Premium Babysitting Service

  1. Basic Duties of the Babysitter:
    • Ensuring the child's safety.
    • Picking up/dropping off the child from/to school or kindergarten.
    • Child hygiene and care, including changing diapers, bathing, etc.
    • Cleaning up after play and meals.
    • Organizing the child's free time, including walks and outdoor play.
    • Heating up or preparing simple meals.
    • Assisting with homework if the Babysitter is capable.
  2. Exclusions from the Premium Service:
    • Teaching school subjects or conducting sports/music classes.
    • Educational actions and psychological support.
    • Pet care.

§3 Premium Hourly Packages

  1. Purchase of Packages: The Client buys hourly packages defining the number of hours, validity period, and specific conditions.
  2. Package Validity: Unused hours cannot be carried over or refunded.
  3. Dedicated Babysitter Service Guarantee: The Client is assured of the service of an accepted Babysitter only with an active package.

§4 Premium Babysitter

  1. Presentation of Babysitter: BENEFIT CARE presents the Babysitter to the Client within one month after signing the Agreement and payment.
  2. Changing the Babysitter: The Client can request a change of Babysitter. BENEFIT CARE provides a substitute until a new Babysitter is recruited.
  3. Babysitter Absence: BENEFIT CARE provides a substitute during the absence of the dedicated Babysitter due to illness or leave.

§5 Work Schedule

  1. BENEFIT CARE and the Client establish a written work schedule ("Work Schedule").
  2. Schedule changes are only allowed if they concern:
    a) Increase/decrease of weekly hours by max. 10%,
    b) Minor time/day adjustments,
    c) Service breaks shorter than 10 days,
    d) Additional duties beyond the agreed Package,
    e) Change of service location.
  3. The Client must notify BENEFIT CARE in advance about changes.
  4. Changes require mutual agreement between all parties.
  5. All modifications must be in writing.
  6. Service pauses >10 days require written agreement.

§6 Service Rules

  1. Service is billed hourly:
    • Agreed Hours: scheduled
    • Worked Hours: actual
  2. Minimum service block: 4 hours. For >24h care, Client provides meals and accommodation.
  3. Holidays count as double hours.
  4. The Client cannot dismiss the Babysitter during service.
  5. Cancellations with <24h notice deduct 2 Package hours.

§7 Fees

  1. Recruitment fee: 1000 PLN gross if the Client withdraws.
  2. Invoices issued based on orders.
  3. Payments to: Millennium Bank, IBAN PL96116022020000000613821963.
  4. VAT rate changes affect only the tax amount, not net prices.

§8 Termination

  1. Agreement is indefinite with 1-month termination notice.
  2. Unused hours after termination are forfeited.

§9 Direct Employment Ban

  1. Client cannot directly employ the Babysitter for 12 months post-contract.
  2. Penalty for violation: 20,000 PLN.

§10 Contract Breaches

  1. Prohibited behaviors include:
    • Offensive treatment
    • Preventing meal breaks
  2. BENEFIT CARE may terminate immediately for gross violations.

§11 Personal Data

  1. Data controller: BENEFIT CARE Sp. z o.o.
  2. Data processed for contract execution and marketing.
  3. Client must keep Babysitter's contact details confidential.

§12 Client Declarations

  1. Client acknowledges the service scope and exclusions.
  2. BENEFIT CARE is not liable for services outside the agreement.

§13 Final Provisions

  1. Competent court: Warsaw, Poland.
  2. Agreement in Polish, two copies.
  3. Amendments require written form.
